Spin Wheel/Prize Wheel Rules - Details of Participation

Official Spin Wheel/Prize Wheel Rules and Conditions: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR ELIGIBILITY IN RECIEVING A PRIZE. VOID WHERE PROHIBITED BY LAW.

Spin Wheel Events: On various days and times, eligible participants will have the opportunity to participate in a Giant Spin Wheel event, located within the American Dream Mall. When the Giant Spin Wheel is not active, Participants will participate in a Digital Spin Wheel event. In both instances, events are open to aged 21 and over. For a chance to spin, eligible participants must complete a digital survey. No prior registration is required. Each eligible participant is entitled to one spin of the wheel. Each spin will result in a prize. Additional spins may be given at the discretion of the event organizers. Both contests have various prizes, and each eligible participant will receive their prize after spinning the wheel via email, in real-time, after providing valid identification to verify age eligibility and a valid email address. In the event the prize delivery system is not functioning properly, prizes won will be delivered via email within 72 business hours from the date the prize is won. All Prizes are subject to availability and are non-transferable and non-exchangeable. The event organizers reserve the right to modify the event(s) or prize offerings at any time without prior notice. By participating in the Giant Spin Wheel event, participants agree to abide by all event rules and guidelines.

Publication of Winner: Except where prohibited by law, acceptance of the Prize constitutes agreement for On Point Marketing Agency LLC (OPMA) to use winner's name, photographs and likeness for advertising and promotional purposes (without review, approval or notification of winner) and in all forms of media, without compensation. Any use of robotic, automatic or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by that entrant. In the event of a dispute as to any online entry, the authorized account holder of the email (person assigned the email address by service provider) used to enter will be deemed to be the entrant. In the event of any dispute regarding the interpretation of these Rules, the decision or interpretation of OPMA shall prevail. OPMA shall have the right to disqualify any entries that OPMA believes in sole discretion are fraudulent or otherwise improper or tainted (however, OPMA shall have no obligation to identify such entries). Warning: any attempt by an entrant or any other individual to deliberately undermine the legitimate operation of the contest is actionable.

Termination of Sweepstakes: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes and or Prize Wheel Game should a virus, bugs, non-authorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes and or Prize Wheel Game. In such a case, the Sponsor may select the recipients from all eligible entries received before and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with or attempts to tamper with the entry process or the operation of the Sweepstakes, website, survey or prize wheel game, or violates these Terms & Conditions.

The Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes and Prize Wheel Game, to void entries for any reason, including, but not limited to, multiple entries from the same user from different IP addresses; multiple entries from the same user using multiple devices, multiple entries from the same computer above that allowed by sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering.

Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person, including the recovery of all attorneys’ fees and costs in the seeking of such damages to the fullest extent permitted by law.

Limitation of Liability, Indemnification, Arbitration: Neither {{c49e-f8c8-7737}} nor any {{c49e-f8c8-7737}} Related Parties shall be responsible for or liable for: (i) misdirected or incomplete entries; (ii) telephone, network, Internet or computer malfunctions or transmission failures of any kind; (iii) any events beyond {{c49e-f8c8-7737}}'s control that cause Contest to be disrupted or corrupted. By participating, entrants release, discharge and agree to indemnify, defend and hold harmless the {{c49e-f8c8-7737}} Related Parties from and against any and all claims (including, without limitation, claims based on publicity rights, intellectual property rights, defamation or invasion of privacy), demands, liabilities, costs or expenses of any kind (including reasonable attorneys' fees) for any damages, injury or losses, to any person (including death), of any kind resulting directly or indirectly from participation in this Contest or the acceptance or misuse of any prize, including any merchandise as applicable. By participating, entrants waive any right to ambiguity in the Rules. {{c49e-f8c8-7737}}'s failure to enforce any provision of the Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision of the Rules is determined to be invalid or otherwise unenforceable, then the Rules shall be construed as if the invalid or unenforceable provision was not contained therein.

The Rules and Contest will be governed by the laws of the State of New Jersey without giving effect to any conflicts of law rules. By entering this promotion, you agree you are subject to On Point's mandatory arbitration and waiver of class action and jury trial provisions (which can be found at https://www.opmarketingagency.com/awl.) You further agree not to claim punitive, incidental, or consequential damages, or any other damages and further waive all rights to have damages multiplied or increased. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore, such exclusions may not apply to you. By entering into this promotion, you agree to indemnify, defend, hold harmless and fully release {{e06b-e562-09d4}} and each of their respective parents, subsidiaries, affiliates (collectively "Indemnified Entities"), and each of the Indemnified Entities' respective officers, directors, agents, contractors and employees for, from and against any claims, costs, damages, liabilities and/or losses (including, without limitation, personal injury and death and attorneys' fees) they may incur in connection with this Contest and/or any prize(s) awarded in connection herewith.
